UI hijab crisis: Court to hear preliminary objection June 25

An Oyo State High Court in Ibadan on Tuesday fixed June 25 for the hearing of preliminary objection in a fundamental human right suit filed by Muslim parents of female students of University of Ibadan International School Ibadan over the school’s refusal to allow their children wear Hijab on their uniform.



The News Agency of Nigeria reports that the preliminary objection was filed by Mr. Tunde Olutayo, one of the respondents in the matter.

Other respondents in the suit are the University of Ibadan, School Principal, Mrs Phebean Olowe, the Chairman, Board of Governors, Prof. Abideen Aderinto and Deputy Vice-Chancellor (Academics) and three others.

Olutayo, through his counsel, Mr Jide Owoyemi, also filed an application for extension of time to allow him to file his processes and urged the court to grant it.

In his response, Counsel for the applicants, Mr Hassan Fagimite, told the court that he was not opposed to the application for extension of time.

Fagimite, however, said that he was recently served with the application for extension of time and the preliminary objection and was yet to respond to it on point of law.

He told the court that he intends to respond to the processes of all the respondents at the same time.

Justice Laniran Akintola granted the application for extension of time and adjourned the hearing of the preliminary objection till June 25.

It would be recalled that ISI had banned female Muslim students in the school from wearing hijab on their school uniform and the female Muslim student protested the decision as a violation of their fundamental human rights.



NAN reports that some Muslim parents instituted legal action against the institution on behalf of their children and they include: Taofeek Yekinni, Idris Badiru, Sikiru Babarinde, Muideen Akerele, Abdur-rahman Balogun and nine others.

The applicants’ counsel, Fagimite, in his originating summon had said that the action of the school authority violated the applicants’ rights to freedom of thought, religion and rights to education as contained in section 38 (1)(a) and 42(1)(a) of the constitution.

He urged the court to declare the continuous refusal of the authority of ISI to allow the female Muslim students to wear hijab on their school uniform as wrongful and unconstitutional.

KIDNAPPERS CHOP OFF BODY OF SENIOR MAGISTRATE

Kidnappers Cut off Body Parts of Kidnapped Nasarawa Magistrate for Paying Only 400k-

Some gunmen have attacked a senior magistrate, Mr Adamu Kuvo, who was abducted in his house in the Agwada, Kokona Local Government Area of Nasarawa State, on May 6.

The men slashed their victim’s face with a knife, stabbed him in the eyes and also cut off part of his lips for paying N400,000 out of the N5m ransom they demanded.

Investigation by Northern City News revealed that the judicial officer was found on a farm along Agwada Road on Saturday by farmers.
A brother to the victim, Mr Abdullahi Osu-Ibaku, said Kuvo was sleeping in his bedroom when the kidnappers invaded his house at Akpwu village around 12am and took him away.
According to him, someone informed him on Saturday that his brother had been found and brought to the Federal Medical Centre, Keffi.
He said, “The kidnappers had demanded N5m ransom and we negotiated with them but they insisted on the amount. We offered N150,000, but they refused to accept it.
“We later increased it to N200,000 and they asked me to bring the money to Udege pegi along Akpwu village.
“After receiving it, they asked me to come the next day when they said my brother would be released. But the following day, I did not see him until on Saturday when someone told me that he had been taken to FMC Keffi by policemen at Agwada police outpost.”
Confirming the incident to our correspondent in a telephone interview, the Division Crime Officer, Agwada, ASP Barshir Dagana, said villagers who saw the victim lying on the farmland reported to the traditional ruler of Agwada.

He explained that the the magistrate was subsequently taken to hospital for medical attention, noting that investigation into the incident had commenced.

Housewife and her pastor lover sentenced to death for the murder of her husband in Edo

A High Court in Benin on Thursday, sentenced a housewife Eniobong Isonguyo and her pastor lover, Udoka Ukachukwu, to death for the murder of her husband, Engr. Victor Gabriel Isonguyo, a staff of Nigerian National Petroleum Company NNPC, Benin, Edo State in 2013.



During the trial, the prosecuting counsel told Court, that the murder of the deceased was carried out by the convicts so as to cover up the pregnancy accusation by the deceased while he was away.

“The deceased’s wife told the pastor to wait on the route of her husband to work and ask him for a ride. The plan paid off as the man eventually stopped and gave the pastor a ride along sapele road Benin. During the journey, the said pastor brought out a sharp object and hit him on his neck before opening the petrol tank, sipped out fuel and burnt him beyond recognition,”




It was established that millions of naira and landed properties belonging to the deceased were transferred to the said pastor by the wife.

The prosecuting counsel said the woman who was four months pregnant as at the time of the incident, later gave birth in Benin prison.



In his ruling Justice Geraldine Imadegbelo held that the prosecution was able to prove the case beyond reasonable doubt.



The Court held that the deceased was killed with a sharp object in his car by the said pastor who then set the car ablaze.


The judge however sentenced them to death by hanging.



The then Commissioner of Police,CP Foluso Adebanjo who narrated how Mrs Enebong Victor Isonguyo planned the murder of her husband with her Pastor lover, Prince Udoka Nkanchukwu, said they both confessed to be lovers and plotted the death of the NPDC staff and father of three. According to him,

“What happened was that the Pastor asked the deceased to meet him somewhere along Sapele road. When the deceased got there, the Pastor stabbed him twice and then burnt the car. The woman gave the husband’s new car to the Pastor and we found the car with the Pastor. After killing the man in his vehicle, he set the car ablaze. The Pastor changed the number plate  of the new car and put a fake one after he murdered the man.”



However, Mrs Isonguyo who denied having extra marital affairs with the Pastor, said:

“When I did not see my husband I ran to the Pastor because we have known for a very long time. I took my husband’s new car to him to sow as a seed in the church so that my husband will be found. I told him to take it to the church but I didn’t know that he went and changed the number plates. I had to ask him to pray harder because I loved my husband and I don’t want anything to happen to him. I did not kill my husband because I loved him.”

ONNOGHEN’S APPEAL STRUCK OUT.

Onnoghen’s suspension by CCT breached his right to fair hearing, Appeal Court rules-

The Abuja Division of the Court of Appeal on Friday struck out an appeal by the ex-Chief Justice of Nigeria, Justice Walter Onnoghen, challenging an ex parte order of the Code of Conduct Tribunal issued on January 23, 2019, for his suspension from office pending his trial before the tribunal.
In a unanimous judgment of its three-month bench led by Justice Stephen Adah, the Court of Appeal however ruled that the CCT’s ex parte order breached the ex-CJN’s right to fairing hearing.


Justice Adah who read the lead judgment noted that the court proceedings ought not to be conducted “in a shady or clandestine manouvre” as manner in which the ex parte order was obtained by the prosecution.
He however struck out the matter on the grounds that the substantive matter had been concluded by the CCT which ended in the ex-CJN’s conviction on charges of false and non-declaration of assets.

President Muhammadu Buhari had on the strenght of the ex parte order suspended on Onnoghen from office on January 25.
